| Chequamegon Student Physically Removed from Bus (Update)
According to a press release, on Wednesday, January 10, 2018, the Park Falls Police Department received a complaint wherein it was reported a Chequamegon School District student was physically removed from a school bus by a Chequamegon School District staff member. This matter was investigated, and the case was then referred to the Price County district attorney for review.
Information reviewed by the district attorney included witness statements, officers' reports, school training records, and two video clips of the incident. One of the video clips only showed the student being removed from the bus. The second video clip showed the entire incident, including activities on the bus prior to the student being removed. Upon review of the case, the Price County district attorney advised that the school staff member did not commit any violation of Wisconsin criminal law.
The investigation also revealed this particular school staff member has training specific to the use of physical restraint and seclusion through the Crisis Prevention Institute. This training satisfied the requirements as set forth in Wisconsin Statute 118.305(6). Furthermore, Wisconsin Statute 118.31(3)(e) permits an employee or agent of a school board to use reasonable and necessary force to remove a disruptive pupil from a school premises or motor vehicle, as defined in Statute 125.09(2)(a) 1 & 4, or from school-sponsored activities.
